There are several ways to dodge a lawsuit.

Whether you’re a plaintiff or defendant, you must know what smart defendants do to dodge lawsuits.

This is called the “flurry of motions”.

Once a defendant files an Answer, he’s locked in and misses this chance to dodge the lawsuit altogether.

Motion for More Definite Statement: This motion should be filed when a Complaint is so poorly-written that a reasonable person would have difficulty understanding what it says, i.e., what the plaintiff is complaining about.

This tactic is sometimes called the flurry of motions.

Here are just a few points you absolutely must know.

The last of these is the most common! If you don’t yet understand causes of action and their elements, you are not yet ready to win in court. The most important piece of knowledge you can learn about lawsuits is that they proceed on one or more causes of action, and each cause of action has certain required elements that must be alleged and ultimately proven. Each is fully explained in my course.

Motion to Strike: The following are a few of the many grounds for filing this motion:

  • The Complaint Contains False Allegations
  • The Complaint Contains Scandalous Allegations
  • The Complaint Contains Impertinent Allegations

The first of these is very powerful and is sometimes called a Motion to Strike Sham Pleading.

Know them all, however.

Motion for More Definite Statement: This motion should be filed when a Complaint is so poorly-written that a reasonable person would have difficulty understanding what it says, i.e., what the plaintiff is complaining about.

The court cannot require you to file an Answer if the Complaint is so poorly-written that no reasonable person could discern what the plaintiff is saying. For example, I’ve filed this motion when sentences in the Complaint had no verb!

If you are sued, do NOT file an Answer until you use all these motions that apply to the circumstances!

MY NEW PLATFORM

My web hosts for this site offered me the chance to migrate to a new platform, from Movable Type to WordPress.  I said yes, go ahead.  The result is what you see now, a big improvement, I think. The layout and design is so much more versatile. It explains why I have been absent for a while.  Another change, which I welcome, is that I now invite my readers to make comments, and interact with me.

There has been a problem which is to do with what is called SEO (Search Engine Optimization).  I don’t want to lose the positions in Google, for example, which have been in prominent places for a long time now. But one also needs to avoid any “404s” showing up, in other words a dead link.  This has meant the arduous task of tagging old entries with the “301″ tag, which means that the URL (Uniform Resource Locator) is redirected to a different permanent address on a different server.

As well, there has been a problem getting the old internal and external links to work, especially the pictures.  Pictures and videos are all important these days.  Readers/subscribers have become more sophisticated, and expect all the bells and whistles to be available.  So we’re working on it.

Bear with me.  I’m no expert, and this is all a learning experience for me too.  But I want to get my story out in the best way possible.

The next stop will be an E-Book.  Stay tuned.

 

How to Make Offers of Proof

From the Jurisdictionary Evidence Tutorial … 

If you begin to offer evidence and, before you can get it before the court, the other side objects and the court sustains the objection,  you must move the court to allow you to make clear on the record what the evidence was.

This is called an offer of proof.

If you don’t get your evidence in and don’t offer the proof, you’ll have nothing to appeal if the court rules against you.

You won’t be able to win on appeal, because the record for the appellate court to review will not show what the evidence would have been!

Therefore, when your attempt to get evidence in is prevented by the court’s sustaining the other side’s objection, be sure to make an offer of proof stating what the evidence would have been and what you intended to prove by it.

Then, if an appeal must be taken to the higher court on the basis that you were not allowed to get the evidence in, you’ll have a record to show what the evidence was (or would have been) and be able to argue that “but for” the excluded evidence you would have won … or, at least, that you should be given another chance on remand to the trial court with instructions from the appellate court!

In jury trials, offers of proof should be made outside the hearing of the jury. In some cases an offer of proof may be made at the bench, but if you make your offer of proof at the bench, make certain the court reporter comes over to the bench along with his or her recording device to take down every word you, the judge, and other side say!

No record = no appeal possible.

No appeal possible = judge free to rule as he chooses!

Not good.

Can you Beat Your Ohio Traffic Ticket?

Minor traffic violations are cases that you might consider self representation. You will likely find that the cost of an attorney is not worth defending a $150 traffic ticket. In most cases, you have the option of just paying the ticket and forgetting about it, but there are ramifications to traffic violations beyond the fine including increased insurance rates and potential license suspensions for repeat offenders. Those additional costs can be even greater for commercial drivers.

You can do a web search and find an array of materials advertising how to beat your traffic ticket. Before you shell out your cash for these magic wands, you should be highly skeptical of their claims. Of course, you can take your case to trial and win under the right circumstances, but there is no magic wand to make your ticket go away. Usually, these materials are not specific to Ohio law and therefore not everything in there will apply to your case. Also, if you delve further, you will find claims like there is a good chance your citing officer won’t show up for trial and you’ll win automatically. In truth, going to court is part of an officer’s job. Often, courts will schedule all the cases that a particular officer has to appear at the same time so he or she doesn’t have to make numerous court appearances. I’m sure it worked for somebody, but taking your case to trial and hoping for the off chance that your citing officer doesn’t appear is hardly what I’d call a great strategy for success. A better strategy is one that doesn’t rely entirely on luck.

In most cases, beating your ticket means getting the charge reduced to something that you can live with. Yes, your violation was probably nothing more than a harmless error and I understand you’re upset because municipalities use traffic violations to add funds to their budget. For now, it’s time to put these feelings aside and consider your best options. So how do you proceed? More to come in future posts.

Nolo’s traffic book is a good read for one who wants to challenge their ticket. Of course, you will have to research state specific rules and how your court operates, but I think you will find the information helpful.
